Article 1: Scope of Application

These Terms and Conditions of Sale (“Terms”) apply, without restriction or reservation, to all sales concluded by the seller (“Madame a dit oui Australia”, hereafter “the Seller” or “MADO”) with non-professional buyers (“the Client”) wishing to purchase the products (“Products”) offered on the website www.madameaditoui.com.au.

By ticking the acceptance box prior to placing an online order, the Client acknowledges that they have read and accepted these Terms. These Terms prevail over any other document.


Article 2: Identity of the Seller

Article 3: Products

Products offered for sale on the website include made-to-measure, semi-custom, and ready-to-wear items, such as:

  • Wedding dresses, blouses, veils, shawls and overskirts.

  • Ready-to-wear bridal clothing and accessories

  • Garment bags and hangers

Product specifications, illustrations, and stock availability are displayed on the website. Clients are responsible for reviewing this information before ordering.

Purchases are subject to stock availability. If an item is unavailable, the Seller may either offer a pre-order with an extended delivery time, or refund the Client if fulfilment is impossible.


Article 4: Prices

Product prices are listed in Australian dollars (AUD), including GST. Design customisations will attract an additional charge however this price will be provided prior to finalising an order with your ambassador. 

Prices may be subject to promotions or adjustments but will always be charged at the rate in force at the time of order confirmation.

Invoices will be issued electronically upon purchase. Prices exclude additional services such as alterations, dry cleaning, or pressing.


Article 5: Orders

The order process includes:

  1. Booking a bridal fitting with one of our ambassadors

  2. Finalising the product selection, customisations and measurements

  3. Completing an order on our website with your ambassador by selecting a product, customisations and adding it to the shopping cart

  4. Applying any promotional code (if available)

  5. Providing billing details and delivery details if required.

  6. Reviewing and accepting the Terms

  7. Confirming and paying securely online

The sale is considered valid only once full payment has been received.

The Seller reserves the right to cancel or refuse any order in the event of a payment dispute or prior default.

Once your dress has been made, your ambassador will contact you to book a final fitting and dress collection. We aim for approximately 2 months prior to your wedding date unless a rush order has been placed.


Article 6: Payment

Payment must be made by credit card via a secure payment gateway at the time of order.

Payments are considered final once credited. No Products will be shipped until full payment is received.

Deposits or instalments, if exceptionally agreed, are non-refundable in case of cancellation by the Client.


Article 7: Custom-Made and Semi-Custom Products

Custom-made and semi-custom Products are produced following precise specifications agreed upon with the Client.

Due to their personalised nature, these items are non-refundable and non-exchangeable. Delivery timelines for custom-made items differ from ready-to-wear and will be specified upon order. 


Article 8: Role of Ambassadors

MADO Ambassadors are independent representatives who assist Clients with fittings, measurements, or styling advice.

Any services performed by Ambassadors are independent from the Seller. 


Article 10: Shipping and Delivery

  • Delivery Zones: Products can be delivered within Australia. International delivery may be arranged on request, subject to prior acceptance and quotation. Customs duties and taxes for overseas deliveries are at the Client’s expense.

  • Delivery Times:

    • Custom-made / semi-custom orders: approx. 4 months

    • Ready-to-wear orders in stock: within 15 business days after order validation

  • Carrier Responsibility: Deliveries are managed by independent carriers. Risk transfers to the Client once the Products are delivered to the carrier, unless the Client chooses their own carrier.

  • Packaging: Wedding dresses are shipped with protective packaging, hanger, and branded garment bag. Additional garment bags or hangers may be purchased separately.


Article 11: Transfer of Ownership

Ownership of Products transfers only once full payment has been received by the Seller, regardless of delivery date.


Article 12: Returns and Refunds

  • Clients may return ready-to-wear Products within 14 days of receipt, provided items are unworn, intact, and in original packaging. Return costs are borne by the Client.

  • Custom-made and semi-custom Products are not eligible for return or refund.

  • Refunds will be processed within 14 days after inspection of returned Products.


Article 13: Guarantees and Liability

Products benefit from consumer rights under Australian Consumer Law (ACL), including guarantees of acceptable quality and fitness for purpose.

The Seller will repair, replace, or refund faulty Products as required under the ACL.
The Seller is not responsible for:

  • misuse or negligence by the Client

  • alterations performed by third parties

  • variations in handmade Products versus website photos


Article 14: Personal Data

Personal information collected is used solely to process orders, deliver Products, and manage customer accounts, in compliance with the Privacy Act 1988 (Cth).

Data is stored securely and will not be shared for marketing purposes without explicit consent. Clients may request access, correction, or deletion of their data by emailing: margaret@madameaditoui.com.au.


Article 15: Intellectual Property

All content on the website www.madameaditoui.com.au is the property of MADO and is protected under Australian copyright law. Any reproduction, in whole or in part, is strictly prohibited.


Article 16: Governing Law & Disputes

These Terms are governed by the laws of New South Wales, Australia.
In the event of a dispute, Clients are encouraged to contact the Seller first to seek resolution. If unresolved, the matter may be referred to consumer mediation or to the competent courts of New South Wales.
